Terms of Service

Please read these terms carefully before using the Automika service. By signing up or using our service, you agree to be bound by these terms.
1. Who we are

In these terms, "we", "us" and "our" refer to Automika Ltd. "You" and "your" refer to the business or individual using our service as a client.
2. What the service does
Automika provides a phone answering and booking service for businesses. This includes:
- Answering inbound calls in your business name
- Asking qualification questions to understand what the caller needs
- Booking appointments into your calendar or booking system
- Sending SMS or email confirmations to you and your customers where applicable
The exact features available to you depend on your plan and the information you provide during setup.
3. Eligibility and account setup
To use Automika, you must be a business or sole trader operating lawfully in the United Kingdom. You must be at least 18 years old.
During setup, you will need to provide us with accurate information about your business, including your business name, the services you offer, your service area, availability, booking rules and any special instructions for handling calls.
You are responsible for keeping this information up to date. If your details change, please let us know promptly so we can continue to answer calls accurately on your behalf.
4. Pricing and payment
Our subscription plans start from £499 per month. The exact price for your plan will be confirmed before you start using the service.
- Billing cycle — subscriptions are billed monthly in advance. Your billing date is set when you first subscribe.
- Late payment — if a payment fails or is overdue, we may suspend the service until the balance is settled. We will make reasonable efforts to contact you before suspending.
- Price changes — we will give you at least 30 days' written notice before any change to your subscription price. If you do not agree to the new price, you may cancel before it takes effect.
All prices are in pounds sterling and exclusive of VAT unless stated otherwise.
5. No long-term contracts and cancellation
There are no long-term contracts. You can cancel at any time.
To cancel, email us at hello@automika.co.uk before your next billing date. Your service will continue until the end of the current billing period. We do not provide refunds for partial months.
We may also cancel or suspend your account if you breach these terms (see section 11).
6. Your responsibilities
For the service to work well, you agree to:
- Provide accurate and complete information about your business, services, pricing, availability and service area
- Keep your calendar and booking system up to date so we do not double-book or book into unavailable slots
- Provide clear instructions for how calls should be handled, including any emergency or out-of-hours procedures
- Review bookings we make on your behalf and verify details with your customers where needed
- Notify us promptly of any changes to your business information or availability
7. Fair use and prohibited conduct
You agree not to use the service to:
- Carry out or facilitate any unlawful activity
- Harass, threaten or abuse callers or any other person
- Send unsolicited marketing messages (spam) through the service
- Mislead callers about your identity, qualifications, location or the nature of your business
- Interfere with or disrupt the service or its underlying systems
We reserve the right to suspend or terminate your account if we reasonably believe you are misusing the service.
8. Third-party services
Our service relies on third-party providers for telephony, AI voice technology, hosting, email and other infrastructure. We choose these providers carefully, but we cannot guarantee uninterrupted service where disruptions are caused by factors outside our reasonable control, including outages at third-party providers, network failures or force majeure events.
9. Important disclaimers
Please be aware of the following:
- Not a regulated service — Automika is not a legal, medical, financial or emergency service. We do not provide professional advice of any kind. If your business operates in a regulated sector, you are responsible for ensuring your own compliance.
- Bookings are based on caller information — we book appointments based on what callers tell us. We cannot verify the accuracy of information provided by callers. It is your responsibility to confirm booking details with your customers if needed.
- Customer no-shows — we are not responsible if a customer fails to attend a booking made through the service.
- Service accuracy — while we aim to handle every call professionally, we cannot guarantee that every call will be answered or that every booking will be error-free. AI systems, like all technology, can occasionally make mistakes.
10. Limitation of liability
To the fullest extent permitted by law:
- Our total liability to you for any claims arising out of or related to the service is limited to the total fees you have paid to us in the three months immediately before the event giving rise to the claim.
- We are not liable for any indirect, incidental, special or consequential losses, including loss of profit, loss of business, loss of data or loss of goodwill, whether or not foreseeable.
- Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
11. Data protection
We take data protection seriously. Full details of how we collect, use and protect personal data are set out in our Privacy Policy.
In plain terms: when we handle calls and bookings on your behalf, we typically act as a data processor processing personal data on your instructions. You remain the data controller for your customers' personal data. We will only use that data to provide the service as described in these terms and our Privacy Policy.

12. Confidentiality
Each party agrees to keep confidential any non-public information received from the other party in connection with the service. This includes business information, call data, customer details and commercial terms.
This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
13. Termination and suspension
Either party may end this agreement at any time by giving notice (see section 5 for cancellation details).
We may suspend or terminate your access to the service immediately if:
- You fail to pay any amount due and do not remedy it within 14 days of us notifying you
- You materially breach these terms
- You use the service in a way that is unlawful, harmful or in breach of section 7
On termination, we will stop answering calls on your behalf. Any outstanding fees remain payable. We will handle any remaining personal data in accordance with our Privacy Policy.
14. Changes to these terms
We may update these terms from time to time. If we make material changes, we will give you at least 30 days' notice by email or through the service. Continued use of the service after the changes take effect means you accept the updated terms.
The current version of these terms will always be available on this page.
15. Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or the service will be subject to the exclusive jurisdiction of the courts of England and Wales.
